Terms & Conditions for Art Gallery Space Artwork Requirements

  1. All artworks must be original, created solely by the submitting artist.
  2. For offline display, artworks must be framed / on stretched canvas with a professional finish.
  3. For online listing, artists must submit high-resolution images of each artwork. If images are not submitted, the artwork will not be listed and the fee is non-refundable.
  4. Artworks must not contain offensive, plagiarized, or copyrighted material belonging to others.

Eligibility

  1. Open to artists aged 6 years and above.
  2. Only individual submissions are accepted (no group submissions).
  3. The artist must have full rights and ownership of the submitted artworks.

Registration & Payment

  1. Registration is confirmed only upon successful payment of the chosen pack.
  2. All fees are non-refundable.
  3. Artists may renew their pack at discounted renewal rates (as per the plan chosen).

Pricing and Sales

Offline Sales (Gallery Display):

  1. Artist sets the final sale price of their artwork.
  2. The gallery takes 25% commission on artworks sold through offline display.

Online Sales (E-commerce Platform):

  1. Artist sets the final sale price of their artwork.
  2. The gallery takes 20% commission on each confirmed online sale.
  3. For add-on Artist Portfolio Pages, no commission applies – buyers contact artists directly.

Delivery & Collection

Offline Display

  • Artists must deliver their artworks to the gallery space in person or via courier.
  • Unsold artworks must be collected within 15 days after the last date of display as per the package. Beyond this period, the gallery is not responsible for storage.
  • By default, the gallery does not courier artworks back to artists. Collection is the artist’s responsibility.
  • On special request, if the artist is unable to collect personally, the gallery can return the unsold artwork through the artist’s recommended courier service. In such cases, all courier and packing charges, as well as any damages occurring during transit, will be the responsibility of the artist or the courier service, and not the gallery.

Online Display

  • Artists must provide accurate details for each artwork (title, size, medium, price, year, description).
  • For all online sales, the artist is responsible for direct delivery to the buyer with proper packing as per the gallery’s packing guidelines (shared after registration).
  • Artworks must be securely packed using bubble wrap, hardboard protection, and waterproof covering.
  • If the artwork is damaged or broken in transit, the buyer will be refunded in full. The damaged artwork will be returned to the artist, and return courier charges will be borne by the artist.
  • The gallery is not responsible for transit damage, but will assist in coordinating communication between the buyer and artist for smooth resolution.

Promotion & Marketing

  1. By registering, the artist grants the gallery permission to use submitted artworks for promotion, marketing, and sales purposes (website, catalogues, social media, exhibitions, digital magazine).
  2. The gallery does not guarantee sales; exposure and sales depend on customer demand.

Copyright & Legal

  1. Artists retain full copyright and ownership of their artworks.
  2. Artists grant the gallery non-exclusive rights to reproduce images of their artworks for promotion and sales.
  3. Artists are responsible for ensuring their works do not infringe on any copyrights or trademarks.
  4. The gallery is not liable for unauthorized reproduction or misuse of artworks by third parties.

Artist Responsibility

  1. Provide accurate information and timely updates about artworks.
  2. Ensure artworks are in good condition and ready for display/sale.
  3. Indemnify and hold the gallery harmless against claims related to copyright, authenticity, or ownership disputes.

Code of Conduct & Promotion Policy

  1. We kindly request artists to be patient and understanding regarding the timing of online exhibition uploads and social media promotions. (Please note that promotions are planned carefully to avoid spamming our audience.)
  2. Requests or repeated follow-ups regarding the timing of uploads may not be addressed, as scheduling will be managed solely by our team.
  3. We value mutual respect. In rare cases where an artist engages in disrespectful behavior or miscommunication with our team, we reserve the right to withdraw their participation from the exhibition.
  4. If participation is withdrawn due to such reasons, the fee will not be refunded; however, the artist may not be considered for future events with us.
  5. By joining the exhibition, artists acknowledge their trust in our efforts and agree to support us by respecting these guidelines.
  6. The scheduling and prioritization of uploads and promotions will be at our discretion, ensuring fairness and balance across all artists.

Agreement

By submitting artworks and completing registration, you acknowledge that you have read, understood, and agreed to these Terms & Conditions of Art Craft Galleria – Art Gallery Space (in collaboration with Simsum Arts).
